Submitted on behalf of the NYFTTA membership:

The NYFTTA board authorizes the president of the board, to form a position and policy (P&P) commission ([committee] in conjunction with the NYFTTA bylaws and rules of protocol)

The P&P position will be structured  to address, negotiate and engage in litigation for the defense of the recreational fishing industry.

Without further authorization or approval from the NYFTTA board, the P&P commission will:

1) Raise funds and/or financial commitments for litigation.
If the funding goal, set by the P&P commission, is achieved, then the following will become effective:

2) Without further authorization or approval from the NYFTTA board, the P&P commission will, however not be limited to:
A) Negotiating all contracts and terms of litigation:
Authority to carry board approval in Negotiating all contracts and terms of litigation.   All policies issued by the P&P commission (agreements and actions) are considered board approved and binding.
B) The P&P Commission will make final determinations regarding any and all litigation decisions against the NMFS and/or ASMFC and/or New York State.
C) May enter into partnerships and/or agreements with organizations and/or persons having similar interests to NYFTTA.
D) The P&P commission will instruct the NYFTTA treasurer to open a designated bank account, entitled "NYFTTA Legal Defense Fund."
E) The P&P commission will report periodically to the NYFTTA board.
F) In the event , the desired funding commitment (goal) is not achieved, the board authorizes refunding all remaining money's equitably to contributors.   Proposal 1) 9.28.04  will be considered rescinded.

This proposal will remain continuous unless rescinded by the NYFTTA board.
In the event, the board rescinds proposal 1) 9.28.04, all remaining funds will be fairly distributed to contributors.

Submitted on behalf of the NYFTTA membership:
NYFTTA will sponsor a display tank, in the Sport Fishing Education Center and Aquaculture facility, Babylon NY, in the name of: Phillip C.  Scocca
NYFTTA will transfer $1,000.00 , from the general treasury, to the SAC.
The Board will invite, as NYFTTA's  guests, the family of Phillip C. Scocca to the Operation Holiday Spirit fundraiser or at an appropriate event (TBA) on December 3 2004.   The board will present the plaque/ display to the members and family members of Philip C. Scocca. This proposal will remain continuous unless rescinded by the NYFTTA board.

Discussion and directive
To oppose the draft 9/04 New York State Marine Recreational Fishing Licenses Program proposal as written.
A Position and Policy document will be presented to the NYFTTA board on October 20, 2004.
The Position and Policy document will include an opposition to the draft 9/04 New York State Marine Recreational Fishing Licenses Program proposal as written.
However, the Position and Policy document will detail NYFTTA's views on this document and may include items that may be more acceptable to members.
